Permission for permanent residence after 5 preceding years of continuous residence

Basic information

Permission for permanent residence can be granted (on application) to foreign nationals after 5 years of continuous residence within the Czech Republic.

Legal status as a permanent resident of the European Community within the Czech Republic is granted by the police to foreign nationals simultaneously with the issue of permission for permanent residence.

If not issued simultaneously with permission for permanent residence this status is granted by the police if the foreign national applies in writing and fulfils the legal conditions.

Conditions for issue of permission for permanent residence:

  • The applicant can prove 5 years continuous residence within the Czech Republic.
  • The applicant submits all the required documents
  • The applicant has not committed any serious breach of public order and has not endangered the security of the Czech Republic or any other EU member state
  • The applicant can prove sufficient financial means to support permanent residence

As of 01.01.2011 residence issues are now dealt with by the Ministry of the Interior or the Czech Republic instead of the Foreign Police.

Who is entitled to apply?

  • a foreign national from an EU country
  • a foreign national from a so-called “third-country”

How to apply

An application for issue of permanent residence within the Czech Republic can be made at the relevant office of the Ministry of the Interior (Department of Asylum and Migration Policy) according to the applicant’s place of residence.

If the applicant is not within the Czech Republic at the time of fulfilling the conditions, the application can be made at a Czech Diplomatic Mission abroad.

Documents and forms

Applicant:

  • A completed and signed application for EU citizens and members of their families, or. application for citizens of third countries
    • forms are available from relevant offices of the Ministry of the Interior of the Czech Republic, or can be downloaded from the Ministry website including instructions in various languages (eg. Vietnamese, Ukrainian, Russian etc.) on how to fill in the forms.
      • when printing out a form from the MI CZ website the original size and colour of the form must be maintained.
  • proof of identity
  • passport, personal ID card
  • 2 x photos (35 x 45 mm)
  • E.g. confirmation of average monthly income from employer, tax statement in the case of a self-employed person, bank statement for the past 6 months.
  • e.g. accommodation contract, rental contract, subletting agreement or written consent of an authorised person to accommodate a foreign national, with a verified signature
  • or a country in which the applicant has lived for a continuous period of more than 6 months within the last 3 years
  • Compulsory only for foreign nationals from third countries
  • applicable in the case that the applicant will not be living with this parent, legal guardian or trustee.
  • Document in proof of sufficient financial means to support permanent residence within the Czech Republic.
  • proof of accommodation in the Czech Republic
  • statement from the Czech Register of Offenders and a similar document from the country of which the applicant is a citizen, or in which the applicant has permanent residence.
  • certificate of test in Czech language
  • approval of parent or other legal guardian or trustee for a child’s residence within the Czech Republic

All documents and supporting materials must be no more than 180 days old, with the exception of passports, registry certificates, photographs (if they resemble the applicant’s true current appearance) and certificate of test in Czech language.

Fees and time limits

Fees:

  • issue of permission for permanent residence – 1,000 CZK
    • issue of permission for permanent residence for a foreign national younger than 15 years of age – 500 CZK
  • issue of a permit of permission for permanent residence indicating the status of long-term residence of a member of family of an EU citizen living within the Czech Republic – 500 CZK

Time limit:

  • applications for permission for permanent residence are dealt with within 60 days of submission

If the application is made via a Czech Diplomatic Mission abroad – 180 days
