Confirmation of temporary residence within the Czech Republic

Conditions for residence of foreign nationals within the Czech Republic are governed by law no. 326/1999 Sb. on residence of foreign nationals within the Czech Republic. This law divides foreign nationals into two groups:

• EU citizens and members of their families
  • including citizens of Norway, Iceland, Lichtenstein and Switzerland
• foreign nationals from countries outside the EU, so-called “third countries”

Citizens of individual EU member states have the right to free movement. Residence of an EU citizen within the Czech Republic is therefore not conditional to the issue of any permission for residence.

 EU citizens may enter and move around the Czech Republic, without any special limitation, purely on the basis of a valid ID card (EU citizen’s ID card or passport).

For a stay of up to 3 months in the Czech Republic EU citizens do not require any permission for residence. In the case of a stay in excess of 3 months an EU citizen is entitled (not obliged!) to apply for issue of confirmation of temporary residence.

 Confirmation is only issued to foreign nationals who intend to stay in the Czech Republic for a period in excess of 3 months, who have not endangered the security of the Czech Republic and who have not caused any serious breach of public order.

In the case of a positive decision on an application for confirmation of temporary residence, the applicant is also automatically issued a personal identification number, known as a birth number.

• only citizens of the EU, Norway, Iceland, Lichtenstein and Switzerland.
  • a legal guardian must apply on behalf of a foreign national younger than 15 years of age
• a member of family of an EU citizen

An application for issue of confirmation of temporary residence can be made at any office of the Ministry of the Interior (Department of Asylum and Migration Policy) within the Czech Republic. Applicants are advised to apply via an office in the location of declared residence as it may be necessary for the applicant to attend in person.

A foreign national is obliged to attend the application hearing in person if requested to do so.

All non-Czech records and documents must be translated into Czech for submission.

Citizen of the EU (or Norway, Iceland, Lichtenstein and Switzerland):

• A completed and signed Application for EU citizens and members of their families
  • forms are available at the relevant offices of the Ministry of the Interior of the Czech Republic, or can be downloaded from the Ministry website
    • when printing out a form from the MI CZ website the original size and colour of the form must be maintained.

• personal identification
  • passport, EU citizen’s ID

• 1 x photo (35 x 45 mm)
• health insurance certificate
  • EU citizens need not submit this certificate if the applicant is in CZ for reasons of employment, business or other paid work

• proof of accommodation in CZ
  • e.g. accommodation contract, rental contract, subletting agreement or written consent of an authorised person to accommodate a foreign national, with a verified signature

• proof of purpose of stay
• to be submitted in the case of employment, business, other paid work, or study.

Member of family of an EU citizen (who is him/herself an EU citizen and who intends to stay in the Czech Republic with an EU citizen temporarily for a period of more than 3 months):

• personal identification
  • passport, EU citizen’s ID

• document proving that he/she is a member of family of an EU citizen (or a dependent)
• 1 x photo (35 x 45 mm)
• health insurance certificate

proof of accommodation in CZ

Fees:

• issue of confirmation of temporary residence for a foreign national within CZ is not subject to any set legal or other fees

Time limit:

• applications are processed within 30 days of submission

in the case of a successful application the applicant is requested by the relevant office of the Dept. of Asylum and Migration Policy MICZ, by phone or mail, to come and collect the Confirmation of temporary residence within CZ.

• Mám jako člen volební okrskové komise nárok na odměnu?
  Členové okrskové volební komise mají nárok na zvláštní odměnu za výkon funkce. Členovi okrskové  volební  komise  přísluší za výkon funkce zvláštní odměna ve výši 1 300 Kč, zapisovateli okrskové volební komise ve výši 1 500 Kč a předsedovi okrskové volební komise ve výši 1 600 Kč (výše odměny je vždy daná vyhláškou a může se měnit).
• Má člen volební okrskové komise nárok na pracovní volno a náhradu mzdy?
  Člen okrskové volební komise, který je v pracovním poměru nebo poměru obdobném pracovnímu poměru, má nárok na pracovní volno v nezbytně nutném rozsahu a na náhradu mzdy nebo platu ve výši průměrného výdělku od uvolňujícího zaměstnavatele (jedná se o úkon v obecném zájmu). Zaměstnavatel pak může případné finanční nároky uplatnit na úřadě.
• Kdy mi bude odměna za funkci člena volební okrskové komise vyplacena?
  Zvláštní odměnu pro členy okrskové volební komise vyplatí do 30 dnů po ukončení činnosti okrskové volební komise příslušný úřad.
